General terms and conditions of sale

The present conditions of sale are concluded on the one hand by the company Bread-France SAS with a share capital of 1.173.944€ whose registered office is located in Saint-Martin, 04200 Noyers sur Jabron, France, registered in the Trade and Companies Register of Manosque under the number 819 515 719 hereinafter referred to as "Bread-France" and managing the Bread-éditions website, https://bread-editions.com and, on the other hand, by any individual or legal entity wishing to make a purchase via the Bread-éditions website, https://bread-editions.com, hereinafter referred to as "the buyer".

Article 1. Subject

The present conditions of sale aim to define the contractual relationship between Bread-France and the buyer and the conditions applicable to any purchase made through the Bread-éditions website, https://bread-editions.com. The acquisition of a product through this website implies an unreserved acceptance by the buyer of these terms and conditions of sale which the buyer acknowledges having read prior to his order. The buyer declares to have full legal capacity, allowing him to commit himself under these general conditions of sale.

The company https://bread-editions.com reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. Therefore, the applicable conditions will be those in force at the date of the order by the buyer.

Article 2. Products

The products offered are those that appear on the Bread-éditions website, https://bread-editions.com of the company Bread-France, within the limits of available stocks. The company Bread-France reserves the right to modify at any time the assortment of products. Each product is presented on the website in the form of a description including its main technical characteristics (content, number of pages, approximate number of recipes, etc.). The photographs are as accurate as possible but do not commit the Seller. The sale of the products presented in the Bread-éditions website, https://bread-editions.com is intended for all buyers residing in countries that fully authorise the entry of these products into their territory.

Article 3. Rates

The prices appearing on the product sheets of the internet catalogue are prices in Euros (€) excluding taxes. The applicable VAT (according to country and regulation) is reflected on the price of the products on the payment page of the site.. Any change in the VAT rate may be reflected in the price of the products. Bread-France reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalogue on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased according to the total amount of the order.
Our books are delivered from France and possible customs charges may apply depending on the final destination of the delivery. These costs are not known to Bread-Editions and are to be paid by the final customer. It is up to the final customer to find out about the legislation in force in his country.

Article 4. Order and payment terms

Before placing an order, the buyer must create an account on the Bread-éditions website, https://bread-editions.com. The account creation section is accessible directly from the side menu bar. At each visit, the buyer, if he wishes to order or consult his account (order status, profile...), will have to identify himself using this information. The company Bread-France offers the buyer to order and pay for his products in several steps :

- Secure payment by credit card (via Stripe): the buyer selects the products he/she wishes to order in the "basket", modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. The next step is to check all the information, read and accept the present general terms and conditions of sale by ticking the corresponding box, and then to validate the order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the secure interface, in order to safely enter his personal credit card details. If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card is irrevocable. In the event of fraudulent use of the card, the buyer may demand the cancellation of the payment by card, and the sums paid will then be credited back or refunded. The responsibility of the bank card holder is not engaged if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction, or even 120 days if the contract linking him or her to the bank so provides. The amounts debited will be reimbursed by the bank within a maximum of one month after receipt of the cardholder's written objection. The holder shall not be charged any costs for the return of the sums.

The confirmation of an order implies acceptance of these terms and conditions of sale, the acknowledgement of having perfect knowledge of them and the renunciation to avail oneself of one's own terms and conditions of purchase. All the data provided and the recorded confirmation will be worth proof of the transaction. If the buyer has an email address and if he has provided it on his order form, the company Bread-France will send him by email the confirmation of the registration of his order.

Article 5. Retention of title

The company Bread-France retains full and complete ownership of the products sold until full payment of the price, in principal, costs and taxes included.

Article 6. Withdrawal

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of his order to exercise his right of withdrawal and thus return the product to the seller for exchange or refund without penalty, except for the return costs, which remain at his expense.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Deliveries of orders are made by different carriers indicated at the time of the order. Delivery times are given as an indication only; if they exceed thirty days from the order, the sales contract may be cancelled and the buyer reimbursed. The buyer will then be reimbursed for the totality of the sums paid, as soon as possible and at the latest thirty days following the date of receipt of the said registered letter with acknowledgement of receipt. The refund will be made in accordance with the provisions of Article L. 222-15 of the French Consumer Code regarding the right of withdrawal. Bread-France may provide the buyer with the tracking number of the package by e-mail. The buyer is delivered to his/her home by his/her postman or by an authorised company. If the buyer is absent, he/she will receive a notice of passage from the postman or the authorised company, which allows him/her to collect the ordered products at the nearest post office or at a relay point during a period indicated by the postal services or authorised company. The risks associated with transport are borne by the buyer from the moment the items leave the premises of Bread-France. The buyer is obliged to check the condition of the packaging and the contents of the goods upon delivery in the presence of the postal service or the delivery person. In case of damage during transport, any protest must be made to the carrier within three days of delivery.

Article 8. Order process

In accordance with the provisions of Article 1127-1 of the Civil Code, the buyer acknowledges having taken, prior to the order, knowledge on the Website:

  • of the different steps to follow to conclude the contract;

 

  • technical means enabling it, before the conclusion of the contract, to identify and correct errors in data input;

 

  • of the language proposed for the conclusion of the contract ;

 

  • in the event of archiving of the contract, the terms of this archiving and the conditions of access to the archived contract;

 

  • the means of consulting by electronic means the professional and commercial rules to which the offeror intends, where appropriate, to subject himself.

The buyer selects on the Website the goods he wishes to order.

In accordance with the provisions of article 1127-2 of the Civil Code, the buyer acknowledges having been given the opportunity to check the details of his order and its total price, and to correct any errors, before confirming it to express his acceptance. Bread-France acknowledges receipt without undue delay and by electronic means of the order sent to it.

The order is the subject of an e-mail confirming the contractual information relating to the order.

The sale will be considered final after sending the confirmation of acceptance of the order by e-mail and after full payment of the price.

ARTICLE 9: Compliance

In the absence of reservations or claims expressly made by the buyer within 3 days of receipt of the goods, the goods shall be deemed to conform to the order, in quantity and quality.

No claim will be validly accepted in case of failure to comply with these formalities and deadlines.

BREAD FRANCE shall rectify as soon as possible and at its own expense, the services provided whose lack of conformity has been duly proved by the purchaser.

Article 10 - Warranty

All products supplied by the company Bread-France benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it may be returned to the company Bread-France who will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by mail to the following address: Bread-France SAS, Saint-Martin, 04200 Noyers sur Jabron, France within thirty days after delivery.

Article 11. Responsibility

The company Bread-France, in the process of distance selling, is bound only by an obligation of means. Its responsibility cannot be engaged for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break of service, or other involuntary problems.

Article 12. Intellectual Property

All the elements of the Bread-éditions website, https://bread-editions.com are and remain the intellectual and exclusive property of the Bread-France company. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photos, logos, visuals or text.

Article 13. Personal data

The company Bread-France is committed to preserving the confidentiality of the information provided by the buyer, which he would be led to transmit for the use of certain services. Any information concerning him/her is subject to the provisions of the law n° 78-17 of January 6, 1978. As such, the Internet user has a right to access, modify and delete information concerning him. Article 14. Settlement of disputes

This contract is subject to French law.
The language of this contract is the French language.
In case of dispute the French courts will have exclusive jurisdiction.
